Garrett County resident Timothy Wayne Upton was convicted of one count of second-degree assault, and a pre-sentence investigation was ordered. In June of last year, a female victim sought medical treatment for injuries she said came from domestic abuse. Forensic Nurse Examiner Sarah Beutelspacher testified as to the nature of the injuries; the jury also heard from the investigating police officer, the victim and several other witnesses.
